Confidential Settlement

The was a wrongful death case filed by three adult children as a result of the death of their 88-year-old mother. The mother had a stroke and was discharged to a skilled nursing facility after being hospitalized. She had severe physical and mental deficits. An assessment by the nurse indicated that she was an “unavoidable fall risk”.

She fell out of her bed at feeding per the facility. We claimed that there should have been a fall mat placed adjacent to her bed that would have likely prevented her death. The fall caused severe fractures to her face and a brain bleed that caused her to die eight days later.

The three children were extremely close to their mother who had lived independently prior to the stroke and was expected to leave the facility and return to her home.
