This presentation explores the historical events that led to the Ku Klux Klan Act. It will also discuss the history of the original law’s enactment. It will also discuss the general contours of the present-day civil rights laws against police brutality and jail brutality that has evolved from the original act. We will discuss 42 USC 1983, 1985 and 1988. We will discuss the venue, jurisdiction and potential parties. We will discuss the elements of the actions that exist as well as Monell liability. We will discuss claims pursuant to the 4th and 14th Amendments. We will also discuss qualified immunity and other defenses.
