Yarborough Applegate and Stritmatter Law have filed a wrongful death lawsuit against Amazon.com, Amazon Logistics, Monice Arnett and Falcon Logistics on behalf of the children and grandchildren of Delia Menera, a 57-year old home healthcare worker from Longview, Washington. The suit, pending in the Superior Court of Washington for King County, alleges that Delivery Associate Monice Arnett, while driving an Amazon owned and branded cargo van and making deliveries of Amazon packages, recklessly ran over and killed Delia Menera while Delia was legally walking in a marked and illuminated crosswalk. Longview Police allege Amazon Delivery Associate Arnett was impaired at the time of the crash, which was captured by a dash camera located in the Amazon van. The disturbing facts of the crash were summarized by Longview Police Department Captain Branden McNew:
Driver Cited For Fatal Vehicle vs. Pedestrian Collision on Nichols Blvd.
On September 29, 2024, at approximately 7:27 PM, Longview Police Department officers responded to a vehicle versus pedestrian collision in the 2800 block of Nichols Boulevard. Upon arrival, officers located a female pedestrian, identified as Delia Menera. Menera was transported to St. John’s Medical Center where she was later pronounced deceased.
The driver, identified as Monice R. Arnett (53 of Vancouver), an Amazon delivery driver operating a company van, reported she was turning southbound onto Nichols Blvd. from Garfield Street when she felt a bump and discovered the pedestrian down in the roadway. Arnett stated she did not observe any flashing crosswalk signals at the time of the collision.
Officers noted Arnett admitted to using a THC vape the night prior and possibly the morning of the incident. While on scene, she was observed smoking a vape, though she stated it was a different device. Arnett voluntarily performed field sobriety tests, displaying several indicators of impairment.
LPD Detectives later recovered a vape device containing THC from Arnett’s vehicle. Video footage obtained from the delivery vehicle showed flashing crosswalk signals active at the time of the collision, and the pedestrian was visibly in the crosswalk with no apparent obstructions to the driver’s view.
Longview Police Detectives reviewed the case with the Cowlitz County Prosecuting Attorney’s Office for felony charges. It was determined that there was insufficient evidence to support felony charges.
On April 21, 2025, Longview Police Detectives served Arnett with a criminal citation for Negligent Driving in the First Degree.
Impaired driving places every road user at risk and carries serious legal and personal consequences. It is every driver’s responsibility to remain sober and fully alert behind the wheel. Safe driving begins with clear judgment, there is no acceptable excuse for operating a vehicle while impaired.

The Complaint alleges Falcon Logistics was a Delivery Service Partner (“DSP”) in the Amazon supply chain. It alleges the e-commerce giant created the DSP Program, in part, to avoid liability when drivers delivering for Amazon injure members of the public. Although Amazon exerts near total control and oversight of almost every aspect of its DSP and “last mile” program, Amazon routinely disclaims legal liability for injuries to members of the motoring public by claiming no direct employment relationship exists between Amazon and Delivery Associates.
The Menera Family and its attorneys fully support Cowlitz County’s efforts to hold Arnett accountable for her actions. They also look forward to ensuring Amazon does not escape responsibility for Arnett’s actions in the civil arena. No measure of civil justice will bring Delia Menera back, but the Menera Family hopes a King County jury will help persuade Amazon to consider the safety of the public instead of profits when they are putting thousands of drivers out on the roadways and putting the public at great risk.
