This presentation will start by exploring the development of the Tegman doctrine, including recent changes and where it stands today. The bulk of the presentation will discuss the practical implications of that doctrinal development, including suggestions for arguments, jury instructions, and special verdict forms in cases with negligent and intentional tortfeasors. This presentation will be based on a case we recently tried in King County Superior Court.
