Medical Negligence
Medical malpractice claims require understanding of complex
medical issues – and extra sensitivity toward the client.
We understand. In fact, clients often tell our attorneys and
staff how much they appreciate our compassion, honesty and
regular communication.
Recent medical negligence cases involve removal of the wrong
kidney, infant bowel perforation, and death associated with
failure to follow up on a radiology report.
The following is a sample of our medical negligence verdicts
and settlements. Let us know if we can help you with a similar
situation.
------------------------------------------------------------------------------------------------------------
Marvin v. Hospital
$8.5 million settlement
Plaintiff’s counsel: Paul W. Whelan, Kevin Coluccio,
Reed Schifferman
When a skilled carpenter went to the hospital for shoulder
surgery, his anesthesia was mishandled. He experienced serious
brain injury and had difficulty getting around when he finally
went home after a 20-day hospital stay.
Settlement was made with the hospital and the physician.
------------------------------------------------------------------------------------------------------------

Paul L. Stritmatter
Our legal team settled a wrongful death case against a surgeon
and a hospital who had been sued for failing to take appropriate
steps after surgery to diagnose and treat our client for a
perforated bowel. We were able to recover $5.25 million for
our client's widow and two children.
------------------------------------------------------------------------------------------------------------
Sargent v. Children’s Hospital & Medical Center
$2.8 million settlement
Plaintiff’s counsel: Paul W. Whelan, Keith L. Kessler
Ten-day-old Justin Sargent was transferred to Children’s
Hospital in Seattle for treatment of an intestinal perforation.
Doctors eventually prescribed 62.5 mcg doses of Enalapril,
a medication for hypertension. About a week later Justin received
a dosage of 625 mcg, ten times the usual amount. The hypotensive
episode that followed left Justin with cerebral palsy, quadriparesis
and impaired vision.

------------------------------------------------------------------------------------------------------------
Lori and Michael Dilio v. Wang Su Jang, O.D., Focus Eye
Care, Lexington Eye Institute, Gregory Hay, M.D.
Confidential settlement
Plaintiff’s counsel: Ray W. Kahler, Paul W. Whelan
Lori Dilio elected to have LASIK eye surgery performed in
British Columbia, Canada. A few days after surgery Lori’s
eyesight was worse. Ray was part of the legal team to help
Lori in her claim against the clinic. Canadian law complicated
the case. A Bellevue eye clinic also was cited in the claim;
pre-surgery exam staff at the Bellevue office should have
diagnosed Lori as a poor LASIK candidate because of her large
pupil size and other factors. With help from Ray and the legal
team, Lori won her settlement.
------------------------------------------------------------------------------------------------------------
Elsbree v. Davis
Confidential settlement
Plaintiff’s counsel: Paul W. Whelan
Medical professionals failed to diagnose the plaintiff’s
bone cancer.

Plaintiff’s counsel: Kevin Coluccio, Paul W. Whelan
An 11-month-old baby died when medical personnel failed to
follow up on a radiology report recommending further studies
that would have shown a duplication cyst of the small bowel.
The baby suffered a bowel perforation at the cyst, resulting
in peritonitis and death.
