Government Liability
The
Lummi Nation v. Engineering Firm
$4.25 million settlement
Plaintiff's co-counsel: Michael E. Withey, Paul L. Stritmatter,
Brad J. Moore
After an engineering company uncovered 28 intact
ancestral remains and took them out of state without notifying
the Lummi tribe, the tribe asked our firm to bring an action.
They wanted to recover the significant costs they had expended
to recover and rebury those remains as well as others that
had been excavated off the site to a landfill. Our legal
team, headed by Mike Withey, Paul Stritmatter and Brad Moore,
won a signifcant legal ruling that the engineering firm
had violated the Indian Graves and Records Act. The decision
paved the way for a $4,250,000 settlement for the tribe
and more than 1,230 tribal members.

Product Defect
Doe’s Estate v. XYZ Tire Company
$1.7 million settlement
Plaintiff’s counsel: Paul W. Whelan, Peter O’Neil
A manufacturing defect in an oversized knobby tire caused
a pickup truck crash that ended the life of a passenger,
a 20-year-old promising professional baseball player. Investigative
work by the plaintiff’s counsel – and the young
man’s father – helped illuminate a history of
manufacturing defects in those particular tires. The man’s
family settled at mediation in September 2003.

Medical Negligence
Crawford Estate v. Hospital and Doctor
$1 million settlement
Plaintiff’s counsel: Kevin Coluccio, Paul W. Whelan
An 11-month-old baby died when medical personnel failed
to follow up on a radiology report recommending further
studies that would have shown a duplication cyst of the
small bowel. The baby suffered a bowel perforation at the
cyst, resulting in peritonitis and death.
